Account Transfers

Our Transfer Team will do everything as possible to help you to move your site with us, however we can’t guarantee the transfer process.
We offer this as a Courtesy Service and we can’t guarantee its availability or the time it can take.

However, in some cases, we won’t be able to help you with an older data transfer of a host.

Remember, the oldest host must provide cPanel, otherwise it won’t be possible to offer this Courtesy Service.

The fact of getting a suscription for automatic payments, generating a double payment, you won’t be able to request a money refund. You will have to cancel the automatic payment, so next month it will be acredited to your account, thanks to the double payment.

If you are a new costumer, you can be eligible for a money refund, but just for first and only time. For example, if you already had an account with us, knowing how our service works and its characteristics, and then you purchase again, or already have a second account, you will not be eligible for a money refund.

All purchases made with discounts, don’t have the possibility of money refund, without exception. If you are a new costumer and accept our terms of service you will have a total refund in a lapse time of 72 hours of working days.

Remember, this is valid only on monthly plans, if you contract us for more than a month, being new costumer or not, we won’t be able to give you a money refund.

Dedicated servers don’t have money refund for service cancellation.

8 ) Shared Hostings (WebHost Offshore and Onshore)

Is your responsability to guarantee that scripts / installed applications on your account, are secure, and the licenses and directories were correctly stablished, independently of instalation method.

If possible, stablish permits in most of the directories to 750 and files to 644.
Users are responsable of take all measures on their account. This includes the compromise of credentials such user name and password (It is necessary you use a secure password).

Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists”, purchased lists, and selling of lists will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, phone, postal mail, email, instant messaging, or usenet/newsgroups.
No organization or entity listed in theROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

Hostingflame reserves the right to:

• Require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
• Charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal for a minimum cost of U$S250. This cost of the clean up fee is entirely at the discretion of Hostingflame.

Resource Usages

User may not:

• Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
• Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
• Run any software that interfaces with an IRC (Internet Relay Chat) network.
• Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our shared servers.
• Participate in any file-sharing/peer-to-peer activities.
• Run games servers or online radios.
• Run cron entries with intervals of less than 15 minutes.
• Run cron entries with intervals of less than 15 minutes.

If any account is detected violating this topics, services will be terminated with or without notice.

INODES
The use of more than 150,000 inodes on any shared account may potentially result in a warning first suspension. Every file (a webpage, image file, email, etc) on your account uses up 1 inode.

Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis can be marked for revision.
Hosting Plans Services can not be reselled to other people.
For this, we have the Reseller Plans. If any account is detected with this infraction, will be suspended or cancelled with or without notice.

9 ) Price Change
We reserve the right to change prices listed on and the right to increase the amount of resources given to plans at any time.

10 ) Dedicated Servers Stock.
If the costumer hires Dedicated Servers, the time limit of deliver is 72 hours. In case of running out of stock you will have the chance to change for another one paying the difference, or you can claim a money refund. In case you accept changing your Dedicated Server, the new one will expire the same day of original hired (wich can not exceed 5 days) and once delivered, you will not be able to claim a money refund.

11 ) Indemnification
Customer agrees that it shall defend, indemnify, save and hold Hostingflame harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against Hostingflame, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.

Customer agrees to defend, indemnify and hold harmless Hostingflame against liabilities arising out of:

• Any injury to person or property caused by any products sold or otherwise distributed in connection with Hostingflame;
• Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
• Copyright infringement.

12 ) Disclaimer

• Hostingflame shall not be responsible for any damages your business may suffer.
• Hostingflame makes no warranties of any kind, expressed or implied for services we provide.
• Hostingflame disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by HostGator and its employees.

13 ) Hostingflame and Disclosure to Law Enforcement
Hostingflame may disclose any subscriber information to law enforcement agencies without further consent or notification to the subscriber upon lawful request from such agencies. We will cooperate fully with law enforcement agencies.

14 ) Leechbox
Rapidleech Service provided by Hostingflame, is strictly for personal use, the public use will result in service suspension without money back chance.

User may not:

• Service Abuse (download or upload more than 8 files at the same time and, or, compress/decompress more than 2 files at the same time.)
• Compress huge files in small parts (for example: a 1 GB file, in 1 MB parts). This makes an overload in the hard disk.
• Try to hack our service premium accounts and/or unauthorized login to the Rapidleech script files. Hostingflame will not allow to access to Rapidleech script files by FTP, cPanel or any other way.
• Provide direct download link of the files hosted on the Rapidleech, forums or other wesites, allowing DMCA demands.
  • Remember, at the first DMCA Report received, the service will be terminated.
    If we detect any kind of abuse, you will be notificated and your account will be suspended for 24 hs. If you are notificated for second time, the account will be suspended and a bill will be generated for the ammount of $10.00 USD, that you must pay to reactivate the service.
• The accounts being more than 5 days suspended, because for miss payment or abuse, will be automatically eliminated.
• Downloading files from your leech to your personal computer, making more than 10 conections simultaneously and with a maximum of 2 files downloading at same time.
• Only services of more than 60GB are allowed to use the leech by more than 1 person at the same time. All the others must only be used by 1 person at the same time.

The fact of not to accomplish with any of these items, may provocate service suspension or termination without notice.

Hostingflame Guarantees to You:

1. Safety and Daily Maintenance of servers, where Rapidleech Services are hosted.
2. Stability of 99% on any server.
3. Repair or try to provide running of any host that modify its website and/or system script, both to upload or download and IPs blocking or protections against systems as rapidleech.

We don’t guarantee the upload or download speed.

Many factors can contribute to this problems:

• The Host you are trying to download, has links problems to the country where your rapidleech is hosted.
• The Host has link problems and/or overload on his servers.
• The company who offers dedicated servers to the host you want to download or upload, has technical inconveniences on its network.
• The Host has disabled its download or upload.
